DCP Abba Kyari was acquitted of charges related to the non-declaration of assets by a Federal High Court in Abuja on March 5, 2026. The court found that the National Drug Law Enforcement Agency (NDLEA) failed to prove its case beyond reasonable doubt.

The NDLEA had filed the charges against Kyari and his brothers in 2022, accusing them of failing to disclose properties linked to them. Justice James Omotosho described the case against Kyari and his brothers as ‘persecution’, emphasizing that the burden of proof lies with the prosecution.

According to the NDLEA, over N207 million and €17,598 were discovered in Kyari’s accounts, leading to 23 counts related to non-disclosure of assets and money laundering. Kyari and his brothers have been in detention since their trials began in 2022. The ongoing cocaine trial against Kyari and four other police officers is separate from the recent acquittal, with the next hearing scheduled for March 16, 2026.

Femi Babafemi, a spokesperson for the NDLEA, noted that the ruling by Justice Omotosho is distinct from the main drug case continuing before Justice Emeka Nwite. Two drug traffickers involved in the cocaine case had previously pleaded guilty and were sentenced to two years in prison in 2022.
